How to Submit a DMCA Notice (If Your Content Is Being Infringed)

If you’re the copyright owner (or have been authorized to act on his or her behalf) and believe that content residing on or accessible through our website infringes a copyright and falls outside the boundaries of “Fair Use”, please send us a formal DMCA notice. In order to ensure that we are able to act as quickly as possible, please provide all of the following information in writing to our Copyright Agent:
Your name, physical address (how can we contact you if we need more info?), email and daytime telephone number.
The specific infringing material that the Take Down Notice should be reported for. Be as precise as possible — such as “the work titled XYZ (from 2023) by ABC, available at [insert URL] on your platform” — so we can locate it right away.
A statement that you are, in good faith, asserting the use was not authorized — and that you would under penalty of perjury testifying to it at trial.
Either a physical signature (if you’re sending by hard copy) or an electronic one (if you’re emailing the notice).
A statement, under penalty of perjury, that the information in the notification is accurate and that you are either the owner of the copyright at issue or an agent authorized to act on their behalf.
If any of these details are missing, expect a slowdown, so double-check before you send!

How We Respond to Your DMCA Notice

When we receive an official DMCA takedown notice, such as the one that contained all of the above elements, here’s precisely what we do with it—no questions asked:
First, we will conduct a prompt investigation of the claim. We will find the material you cite and confirm that it corresponds to what you describe. If we determine that it probably is infringing, we’ll remove it or block access to it immediately and prevent the user from using for your copyrighted material in future.
Then we’ll let you (the person who filed the notice) know that we’ve taken action on your request and give the user with the reported content a heads-up. They’ll have a chance to read over the notice and determine if they want to submit a counter-notice (more on that later).

The Counter-Notification Process (If You Believe Your Content Was Removed by Mistake)

We get it—mistakes happen. If your content was taken down from CineJugaad as a result of a DMCA notice, but you don’t believe the removal to have been lawful or fair, then you can try filing a counter-notice. This is what you should include:
Your complete contact information: name, physical address, email address, and phone number (the same information as before —we want to be able to contact you!).

And we will respond to an appropriate counter notice with what that means and quite possibly, less than favorable news for the person filing the DMCA notice so we can provide them with your information. We tell them that we may put your content back up — unless they get back to us within a certain time frame with original court documents stating they’ve sued you to stop the content from going back again. Should we not receive that court notice, we will reinstate your material.”

What Happens to Repeat Infringers?

Per DMCA guidelines, we have to strike over users who will not stop posting infringing works. If a user receives several valid DMCA notices on different content, they will be banned from CineJugaad. We don’t like doing this — but if we don’t protect copyrights, then repeat offenders will lose just another thing they take for granted.
